EXTENDED WARRANTY TERMS AND CONDITIONS
QUATIUS AUSTRALIA PTY LTD
Trading as SONIQ


Quatius Australia Pty Ltd (ABN 90 130 310 048) trading as SONIQ ("SONIQ") offers, on payment by you, 36 month extended warranty in relation to its televisions and consumer electronic products ("Product"). The following terms will apply if the purchaser purchases an Extended Warranty for their Product.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.  You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded.  Nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified.
EXTENDED WARRANTY
Subject to the conditions, limitations and exclusions below, SONIQ warrants that the Product will be replaced or repaired if, during the Extended Warranty Term, defects have occurred in the Product due to wear and tear or accidental damage.

The Extended Warranty Term commences on the date of original purchase of the Product, and valid for a total of 36 months inclusive of the standard express warranty terms of 12 months.

The Extended Warranty covers the original purchaser only, on production of the Extended Warranty Card, and it is not transferrable if the Product is sold by the original purchaser during the Extended Warranty Term. Original purchaser must purchase the Extended Warranty within 3 months of original date of purchase of the Product. Proof of purchase of the Product must be presented upon Extended Warranty purchase for verification purposes.

If a defect covered by the Extended Warranty appears, SONIQ will, in its sole discretion, either:
(a)    offer the purchaser the option to upgrade the Product and pay the difference in the purchase price between the Product and the new product but if the purchaser decides not to upgrade then SONIQ must comply with subsections (b) or (c).
(b)    repair or replace the Product or the defect part of the Product free of charge; or
(c)    cause the Product or the defective part of the Product to be replaced or repaired by an authorized repair agent.

SONIQ reserves the right to replace the Product or defective parts of the Product with a product or parts and components of similar or better quality, specification, grade and composition where an identical product or component is not available.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

If the Product is replaced during the Extended Warranty Term, the Extended Warranty continues for the balance of the Extended Warranty Term.




PRIORITY REPLACEMENT COVER

Some products may be subject to the Priority Replacement Cover. If the purchaser obtained or was provided with Priority Replacement Cover for a Product, and a defect covered by the Extended Warranty appears, SONIQ will replace the Product by collecting the defective Product and delivering the replacement product at the purchaser's nominated address within an Australian capital city. If the purchaser has obtained Priority Replacement Cover but does not reside in an Australian capital city, the purchaser is responsible for any travel and accommodation costs associated with SONIQ or an authorized repair agent attending the purchaser's home.

EXTENDED WARRANTY CLAIMS

If a fault covered by the Extended Warranty occurs, the purchaser must follow the Extended Warranty Claim Procedure attached.   

EXCLUSIONS
The Extended Warranty will not apply where:
(a)    the defect has been caused by intentional damage by the purchaser or a third party;
(b)    the alleged defect is within acceptable industry variances;
(c)    the serial number on the Product has been removed or altered;
(d)    verification of the serial number or original proof of purchase and the Extended Warranty Card cannot be produced; or
(e)    SONIQ or its authorised repair agent cannot establish any fault in the Product after testing.

The Extended Warranty does not extend to:
(a)    physical damage;
(b)    rechargeable batteries;
(c)    LCDs (Liquid Crystal Display) or plasma panels where there is a small number of defective cells (pixels). An LCD/plasma panel consists of millions of tiny cells(pixels). During the normal manufacturing process, a few cell defects may occur. Those tiny dots visible on the screen have no adverse effect on the performance of the TV and the TV is not considered defective. Therefore the appearance of a few (less than 1%) defective cells is not sufficient cause for the TV to be returned or repaired; or
(d)    image retention or burn-in which can be a problem for phosphor based displays. In extreme cases this can be permanent.

OTHER TERMS AND CONDITIONS
On Public Holidays, or other periods where regular business and wholesale operations are temporarily unavailable, response times may extend beyond the standard response times.

Where SONIQ or an authorized repair agent attend the purchaser's premises and the Product is mounted higher than 1.2m from the lowest mount point, an extra service charge may apply to dismount the Product.

Neither SONIQ nor its representatives provide loan equipment under the terms of the Express Warranty.

Repairs or services required that are outside these terms of Extended Warranty may require a credit card payment prior to commencement of such services.

Please retain your sales documentation, as this should be produced to validate a warranty claim. Please keep and present this Extended Warranty card and original invoice during each service. For your reference, please enter the particulars of your purchase below and retain with your purchase documentation.

LIMITATIONS
SONIQ makes no express warranties or representations other than set out in the Express Warranty.

The repair or replacement of this product or part of this Product is the absolute limit of SONIQ's liability under this Extended Warranty.


EXTENDED WARRANTY CLAIMS PROCEDURES

Before lodging a claim, please ensure you have understood the terms and conditions of the Extended Warranty.

Before Lodging a Claim:
Check to ensure that the installation of all power cables to the power points are secure and that the power is turned on.
Check all cables leads and connectors are connected properly and that all switches are turned on and functioning.
Check that all settings are set according to the instruction manual.
Obtain your certificate as proof of purchase and ownership of product.

Claim Lodgment:
Please have your original receipt, model and serial number ready for lodgment of claim.
Call SONIQ Warranty Assist Australia 1300 765 663. Service claims may be made weekdays from 9 am to 5:30pm AEST, excluding public holidays. Or, alternatively you can contact us via email ( This e-mail address is being protected from spambots. You need JavaScript enabled to view it ).
Quote your model and serial number, and provide full details of the alleged defect to our friendly staff.
Our staff will then provide you with a Job Number.
You will then be required to email or fax a copy of your original receipt for verification before we schedule your job as part of our In Home Warranty service.
You will then need to make the Product available to SONIQ or an authorized repair agent for inspection or testing.
If such testing finds no defect in the Product, you will be charged a No Fault Fee of $150.00 to cover the costs of service work and testing.
The purchaser must bear the cost of the transport of the Product to and from SONIQ or the authorized repair agent to make the warranty claim, and all insurance of the Product.
